1. Acceptance of Terms
By accessing or using this website (the "Site") or submitting any quote request, you agree to be bound by these Terms of Service. If you do not agree, do not use the Site.
2. Nature of Our Service
Rock Hill HVAC Experts ("we," "us," "our," or "the Company") operates as an independent lead-generation and referral service. We connect homeowners with independent, third-party HVAC contractors in and around Rock Hill, South Carolina. We are not a licensed HVAC contractor. We do not perform HVAC repair, installation, maintenance, or related work ourselves. All HVAC work is performed by independent third-party providers who are solely responsible for the services they deliver, including pricing, scheduling, licensing, insurance, workmanship, materials, warranties, and compliance with all laws and regulations.
3. No Warranty
The Site and all referrals are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, or quality of service. We make no representations or warranties regarding the qualifications, conduct, pricing, workmanship, or results of any third-party contractor. You are solely responsible for verifying the credentials, licensing, and insurance of any contractor before engaging them.
4. Limitation of Liability
To the fullest extent permitted by law, the Company, its owners, operators, employees, agents, affiliates, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages — including without limitation property damage, personal injury, lost profits, lost data, business interruption, or any damages arising out of or related to (a) your use of or inability to use the Site, (b) any referral to or interaction with any third-party contractor, (c) any goods, services, work, advice, or representations of any third-party contractor, or (d) any unauthorized access to or alteration of your data. In no event shall our aggregate liability exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability; in such jurisdictions, our liability is limited to the maximum extent permitted by law.
5. Indemnification
You agree to defend, indemnify, and hold harmless the Company and its owners, operators, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of the Site, your interactions with any third-party contractor, your violation of these Terms, or your violation of any rights of any third party.
6. User Conduct
You agree not to use the Site for any unlawful purpose; not to submit false, misleading, or fraudulent quote requests; not to interfere with the Site's operation or security; not to attempt to access any portion of the Site not intended for public use; and not to use the Site to harass, abuse, or harm any person.
7. Communications Consent
By submitting a quote request, you expressly consent to be contacted by the Company and by one or more partner HVAC contractors at the phone number and email address you provide, including via automated dialing systems, prerecorded messages, and text messages. Standard message and data rates may apply. Consent is not a condition of any purchase. You may opt out at any time.
8. Intellectual Property
All content on the Site, including text, graphics, logos, images, and software, is the property of the Company or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works without our prior written permission.
9. Third-Party Links
The Site may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of any third-party site.
10. Modifications
We may modify these Terms at any time by posting an updated version on the Site. Your continued use after such posting constitutes acceptance of the modified Terms.
11. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason.
12. Governing Law & Venue
These Terms are governed by the laws of the State of South Carolina, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms or the Site shall be brought exclusively in the state or federal courts located in York County, South Carolina, and you consent to the jurisdiction of such courts.
13. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding the Site.
